What is a Modern Award?
A Modern Award is a legal document that sets minimum pay rates and employment conditions for employees covered by a particular industry or occupation. Awards can include requirements for ordinary hours, breaks, overtime, penalty rates, allowances, rostering and other workplace conditions. Fair Work describes Modern Awards as legal documents setting minimum rates and conditions on top of the National Employment Standards.
How do I know which Modern Award applies to an employee?
Award coverage generally depends on the employer's industry, the work performed by the employee and the coverage provisions of the Award. Some businesses may have employees covered by different Awards, so the correct Award needs to be considered for the particular role rather than assumed across the whole workforce.
How is an employee's Award classification determined?
Award classifications describe different types and levels of work. The correct classification can depend on factors such as the duties performed, level of responsibility, supervision, experience and qualifications required for the role. The classification is important because it helps determine the employee's minimum pay rate.
Is the National Minimum Wage the same as an Award rate?
No. The National Minimum Wage generally applies to employees who are not covered by an Award or registered agreement. Employees covered by an Award or enterprise agreement are entitled to the minimum rates that apply under that instrument, which may be higher.
Do Award pay rates include overtime, penalties and allowances?
Not necessarily. Modern Awards can contain separate requirements for penalty rates, overtime, allowances, casual loading and other payments in addition to an employee's ordinary minimum rate. What applies will depend on the Award and the employee's working arrangements.
How often do Award pay rates change?
The Fair Work Commission reviews the National Minimum Wage and minimum Award rates each year through the Annual Wage Review. Changes usually take effect from the first full pay period on or after the relevant commencement date, although some Awards may also change at other times.
