What is an employment contract?
An employment contract is an agreement between an employer and employee that sets out the terms and conditions of employment. It can be written or verbal, although a written contract provides a clear record of what has been agreed.
Does an employment contract override a Modern Award?
No. An employment contract cannot provide less than an employee’s minimum entitlements under the National Employment Standards, an applicable Modern Award or enterprise agreement. The contract operates alongside those minimum requirements.
What should be included in an employment contract?
The terms will depend on the role and workplace, but a contract will commonly address matters such as the position, employment type, remuneration, hours or work arrangements, duties, notice and other agreed employment conditions.
Do employees need a written employment contract?
An employment contract can be written or verbal. However, putting the agreed terms in writing gives both the employer and employee greater clarity and a record of the employment arrangement.
Can you review employment contracts we already use?

Are there different requirements for casual and fixed-term employees?
Yes. Employment type matters. Casual employees must receive the Casual Employment Information Statement at required times, while employees entering a new fixed-term contract must receive the Fixed Term Contract Information Statement. All new employees must also receive the Fair Work Information Statement.
